The Inglewood Community Garden Rental Agreement — Terms and Conditions

1. Read and abide by these Terms and Conditions and Code of Conduct.
2. Pay the specified bed rental fee of $75 for a raised bed in the Inglewood Community Garden within the specified time frame announced during the seasonal rental program.
3. You must attend or already have attended an in-person orientation session before gardening by yourself in the Inglewood Community Garden.
4. Complete and submit the Inglewood Community Garden Personal Liability Waver before gardening by yourself in the Inglewood Community Garden.
5. Complete and record, in the volunteer log book, a minimum of 5 hours of community work in support of the Inglewood Community Garden or pay the volunteering fee of $75 in lieu of the 5 hours.
6. Have your bed planted by the date specified by ICG administrators for that gardening season and cleaned up by end of business on Thanksgiving Day of the annual gardening season.
7. Contact information: provide your email address, which the ICG may use for routine communication or special notices, your postal code and your telephone number.
   1. Notify the garden’s administrators promptly if your contact information changes.
8. Gardeners must be residents of the city of Calgary to rent a bed in the Inglewood Community Garden.

Code of Conduct

1. Children must be adequately supervised at all times.
2. Disruptive, disrespectful, or abusive behaviours are unacceptable.
3. All pets must be kept on a leash at all times, all pet droppings must be removed by the pet’s companion.
4. Use only natural and / or organic fertilizers and remedies; if in doubt contact the garden’s administrators.
5. Harvest only crops grown in your own bed.
6. Maintain your assigned bed during the growing season according to the following guidelines:
   1. Be considerate of neighbouring beds, for example, not blocking sunlight with tall structures or plants.
      1. All structures on or attached to a raised bed are temporary and must be dismantled at the end of the gardening season.
      2. No structure on or attached to a raised bed may be higher than 2m (6 feet 6 inches) above the ground level adjacent to the outside of the bed.
   2. Keep your bed and the area around your bed free of weeds.
   3. Keep the area between your bed and adjacent beds clean of refuse.
   4. Maintain the tools and facilities belonging to the Inglewood Community Garden in a responsible manner.
   5. If you are unable to maintain your bed, notify the garden’s administrators in a timely manner.
   6. If your bed does not appear cared for, you will be given notice. If the conditions causing the notice are not addressed within 48 hours of such notice being emailed the produce in the bed will be harvested and donated to a charitable organization and you may forfeit your gardening privileges.

PLEASE NOTE Failure to comply with any of the above commitments may result in the suspension or loss of your gardening privileges and prevent you from renewing your rental bed.

The Inglewood Community Garden Personal Liability Waiver — Terms and Conditions

1. Participation in any activity within the grounds of the Inglewood Community Garden or at any other location while acting on behalf of the Inglewood Community Garden is at the participant’s own risk.
2. Any and all claims for damage to personal property or personal physical injury must be waived by the applicant as a condition to participation in any activity within the grounds of the Inglewood Community Garden or at any other location while acting on behalf of the Inglewood Community Garden.
3. Responsibility for damage to property or physical injury to themselves or to others as a result of their activities within the grounds of the Inglewood Community Garden or at any other location, while acting on behalf of the Inglewood Community Garden, must be accepted by the applicant as a condition to participation in any activity.
4. In consideration of the foregoing the applicant agrees to …
   1. … waive, release, absolve, hold harmless and indemnify the Inglewood Community Garden, its officers, agents, employees and volunteers from and against all damages, claims, demands, suits or proceedings resulting from my actions.
   2. … accept that damages may include, but are not limited to, damage or loss of property or physical injury to myself or to others.
5. Minors are the responsibility of their parents, legal guardians or adult companions at all times, consequently and with regard to the foregoing the applicant agrees to accept responsibility for all risks to, and conduct of, any minor children in their care, including but not limited to the damage or loss of property or physical injury to themselves or to others.
6. The applicant grants permission to the Inglewood Community Garden to make use of photographs, digital images or recordings of their activity in the Inglewood Community Garden for the purposes of public relations, training or marketing of the Inglewood Community Garden.
7. By signing a physical version of this document or providing your name and selecting the agreement check box on the online form, the applicant agrees that their attendance and involvement in any activity within the grounds of the Inglewood Community Garden or at any other location while acting on behalf of the Inglewood Community Garden, is at their own risk, and that they have read, understood and consent to the foregoing terms and conditions of this document.

ICG New Gardeners Rental and Volunteer Programs Terms and Conditions

In-person Orientation

• All new gardeners are required to attend an In-person Orientation before working in the Garden UNLESS you have already attended an In-person Orientation.
• Your In-person Orientation session will be arranged by email, text message, or telephone call.

Volunteer Program

• The volunteer requirement is 5 hours per rental bed per gardening season.
• If you have an “assistant gardener” or “secondary contact” their volunteer hours will accumulate to your bed.
• The volunteer program will focus on the ICG’s Communal Garden.
• Volunteer activities in the Communal Garden will include preparing beds, planting, tending, watering and harvesting.
• Volunteer activities in the Communal Garden will be group oriented and supervised.

Fees

• New gardeners must pre-pay a $75 volunteering deposit in addition to their bed rental fee of $75 in order to rent a bed, for a total of $150. This $75 deposit will be refunded to you at the end of the gardening season if you have volunteered at least 5 hours. We want new gardeners participating in the communal garden and have found that the deposit helps encourage this. If you return to the garden in future seasons we will not require this volunteering deposit.

• Partial refunds of the deposit will NOT be available — so remember to record all your volunteer hours.

Fee Payments

• All new gardeners must complete their fee payments in full by the date emailed to them upon submission of their online form.
• Fee payments to be made by Interac e-Transfer (EFT, Electronic Funds Transfer) to payments@inglewoodcommunitygarden.ca.

Bed Assignments

• All new gardeners will be assigned a bed — assignments will be communicated by email.
