The Inglewood Community Garden Personal Liability Waiver

Due to the uncertainties involved concerning Covid-19 we will finalise any additional health related requirements closer to the opening of the Garden in the Spring and will communicate them to returning gardeners, new gardener applicants and volunteers by (newsletter) email as well as posting them to our website and social media platforms.

In order to reduce the potential insurance exposure of the Inglewood Community Garden and its board of directors, we require than everyone working in the garden by themselves or working unsupervised by a designated authority completes and signs the Inglewood Community Garden Personal Liability Waiver.

The Inglewood Community Garden Personal Liability Waiver cannot infringe upon your statutory rights but it is essential in the sense that it indicates the seriousness with which we treat the well-being of our gardeners and their guests.

In order to be able to give your informed consent we further require that everyone working or gardening in the ICG be adequately oriented to the ICG’s safety provisions, best garden practice and code of conduct.

Terms and Conditions

1. Participation in any activity within the grounds of the Inglewood Community Garden or at any other location while acting on behalf of the Inglewood Community Garden is at the participant's own risk.

2. Any and all claims for damage to personal property or personal physical injury must be waived by the applicant as a condition to participation in any activity within the grounds of the Inglewood Community Garden or at any other location while acting on behalf of the Inglewood Community Garden.

3. Responsibility for damage to property or physical injury to themselves or to others as a result of their activities within the grounds of the Inglewood Community Garden or at any other location, while acting on behalf of the Inglewood Community Garden, must be accepted by the applicant as a condition to participation in any activity.

4. In consideration of the foregoing the applicant agrees to …

a. … waive, release, absolve, hold harmless and indemnify the Inglewood Community Garden, its officers, agents, employees and volunteers from and against all damages, claims, demands, suits or proceedings resulting from my actions.

b. … accept that damages may include, but are not limited to, damage or loss of property or physical injury to myself or to others.

5. Minors are the responsibility of their parents, legal guardians or adult companions at all times, consequently and with regard to the foregoing the applicant agrees to accept responsibility for all risks to, and conduct of, any minor children in their care, including but not limited to the damage or loss of property or physical injury to themselves or to others.

6. The applicant grants permission to the Inglewood Community Garden to make use of photographs, digital images or recordings of their activity in the Inglewood Community Garden for the purposes of public relations, training or marketing of the Inglewood Community Garden.

7. By signing a physical version of this document or providing your name and selecting the agreement check box on an online form, the applicant agrees that their attendance and involvement in any activity within the grounds of the Inglewood Community Garden or at any other location while acting on behalf of the Inglewood Community Garden, is at their own risk, and that they have read, understood and consent to the foregoing terms and conditions of this document.
